KENNEDYS LAW – 27 September 2023
”As you ought to be aware, the date of an application is not necessarily the date the SSHD will begin to review the supporting documents. It is only after the biometrics have been enrolled that the SSHD begin the review. We refute your claim that the Home Office requires all supporting documentation at that time. Any documentation provided to the Home Office following enrolment of biometrics, is considered by them up to the date of a decision being made.”
GARDEN COURT – 11 January 2024
“It is denied that the filing was “unaccountably late”. The documents were filed on this date because it was the date of the Claimant’s biometric appointment. It is normal practice for representatives to file representations and supporting documents when an applicant attends their biometric appointment, as the application will not be substantively considered before this time. There was extensive email correspondence between the Claimant and Defendant regarding the timing of his biometric appointment, and the date was chosen in light of the Claimant’s other commitments.”
OUR COMMENTS
Kennedys Law performed no due diligence to check facts. UK Migration Lawyers failed to upload the selfie to the Home Office. A simple search of UK Migration Lawyers’ Subject Data Access Report would have provided this information. Two immigration solicitors, one immigration barrister, two insurance solicitors and one practice manager ought to know of its existence when handling an immigration insurance claim.
Kennedys Law and UK Migration Lawyers are directly responsible for escalating the legal costs and refusing to participate in alternative dispute resolution.

OUR COMMENTS
UK Migration Lawyers were asked directly whether it was possible to reuse the previously enrolled biometrics.
