A SUCCESS STORY

We were successful in obtaining the 5-year entry visa via a reputable law firm. They confirmed they had assisted another client in obtaining a 5-year entry visa around the same time UK Migration Lawyers submitted our application – it took the Home Office 28.6 weeks (5.23 months) to approve their clients’ application:

”We had a client in a similar position. She and her husband came to us for advice, following refusal of a visa application she had made herself. She had in fact made the wrong application. We advised her to make an application for a spouse visa – which was in fact an application on the basis of family life or other private life.

We advised our client that the application must be submitted by 1 January 2021 to rely on the (at that time) current concession to switch to a family visa in the UK under the Coronavirus Guidance. Applicants in the UK as a visitor are not normally able to switch into another route. We submitted detailed representations with her application because it was relying on this concession, addressing both why it was urgent and why she could not apply from abroad. We explained that she would ordinarily have applied for entry clearance from her country of residence but could not do so due to the pandemic.

We were instructed on 29 December 2020 and her application was submitted on 31 December 2020 (due to the concession being due to end on 1 January 2021 – it was extended). Her permission was granted on 21 June 2021.

As she was in the UK as a visitor, she would not have been permitted to submit this application, had it not been for the covid concessions in place. Had the concession to make an in-country application not been available, we would have advised our client to return to her home country to apply for an entry clearance visa as a spouse/partner.”
